Terms and Conditions for My CP & Me

These terms of service (“Terms”, “Agreement”) are an agreement between the operator of My CP & Me (“Website operator”, “us”, “we” or “our”) and you (“User”, “you” or “your”). This Agreement sets forth the general terms and conditions of your use of the https://www.mycpandme.com website and any of its products or services (collectively, “Website” or “Services”).

  1. Description of My CP & Me Services

My CP & Me provides users with access to content (some of which requiring registration) including, but not limited to: (a) information about Cerebral Palsy and its causes (b) an explanation on the different types of CP (c) resources (in both online and ebook formats) some of which specifically meant for parents/caregivers, whereas others are generic resources for anyone (d) with the chat feature you can post your own stories as well as privately communicate with other members. With groups you can even communicate with a collection of people all at once.

1.1 Information About Cerebral Palsy

My CP & Me provides you with basic information on what Cerebral Palsy is, and how it can affect people differently. This information is available to everyone without the need for registration, and can be found under the About tab.

1.2 An Explanation About the Different Types of CP

We provide an explanation on the different types of CP & how they can affect others differently. This information is freely available, and therefore does not require the need for an account.

1.3 Resources for Anyone

We have a vast variety of resources readily available to you. These resources come in two forms: Websites and electronic books that can be purchased from Amazon.  There are even links to other Cerebral Palsy blogs, so you can expand your thinking and learn more about CP from different perspectives. No account is required.

1.4 Resources for Parents & Caregivers

My CP & Me even has resources specifically meant for the caregiver of people with CP. We have several websites specifically broken down in our Resources section and even ebooks available through Amazon that were written by professional writers, some even doctors. No account is necessary for this service.

1.5 Getting Social

We provide you with the ability to converse with other people in a similar situation to your own. Under the CHAT tab you will find three (3) sections: Activity, Groups, Members. An account IS necessary to use this service. Under the Activity section you can see post by other account owners, and it is one way for you to compose your own posts. The Groups section has been divided into three (3) categories: Teens, Adults, Parents & Caregivers. The teens section is for people ages 13 – 17 who are personally affected by CP. The Adults group is for people ages 18+ who are personally affected by CP. The Parents & Caregivers group is for any loved one who has been affected by CP, but not personally. This could be a mother of a child with CP, a grandparent, a father, a brother, a sister, a spouse, an aunt, an uncle, a cousin, etc. However, the loved one must comply with our age requirement of 13. (more on age requirements in sect 2 Accounts & Membership). Private messaging to specific individuals can be done as well. You have the ability with an account to post to, and create forums for group discussions.

2. Accounts and Membership

You must be at least 13 years of age to use this Website. By using this Website and by agreeing to this Agreement you warrant and represent that you are at least 13 years of age. If you create an account at the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.

2.1 The Registration Process

Anyone 13 years of age or older can request an account to get full access to My CP & Me services. In order to register you must go to the Create An Account page, which is located underneath the login field. After you submit your request for an account we will set your account up with the information you provided in the form. Within 48-hours you should receive an email from noreply@mycpandme.com containing instructions on how to activate your new account. In addition to receiving the activation email you shall receive an email to verify the email address on file, containing a unique verification code. You must verify your email with this code to keep your account active; failure to verify your email within 48-hours from the time your account was created will result in the termination of your account. We require a verified email address with you in order to ensure secure communication between you and us.

2.2 Voluntary Closure of Your Account

You may close your account at any time.To do so please follow the instructions on the “Close Your Account” page which can be found at the bottom of your profile page. After the request, has been made you shall receive an email from noreply@mycpandme.com confirming the account has been locked pending closure. Please note that closing your account does NOT remove you from newsletter mailing lists unless otherwise stated. Although data (i.e. past posts, messages, etc.) will be purged from our systems after the allotted 2 week period has passed without a request to reactivate your account upon voluntary closure. To reactivate your account please see the Account Reactivation page and be sure you have the Reactivation Code provided to you in the Account Pending Closure email. Without this code you will not be able to reactivate your account. Account reactivation requires two (2) things from you (a) you must provide the email address associated with your account in order for us to identify the account being reopened (b) the reactivation code in order for us to validate that you are the account owner requesting reactivation.

2.3 Termination of Inactive Accounts

If you fail to show public activity (such as a post to the blog) on your account for twelve (12) months the account shall be considered inactive. (just sending a private message won’t keep your account from being deactivated you have to demonstrate real use of your account) As such you hereby relinquish all rights to your account (and the content therein.) Your account, after this time period has passed, shall be deleted (without notice to you) by us and we will remove the information therein.

3. User Content

We do not own any data, information or material (“Content”) that you submit to the Website in the course of using the Service. You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted Content. We may, but have no obligation to, monitor Content on the Website submitted or created using our Services by you. Unless specifically permitted by you, your use of the Website does not grant us the license to use, reproduce, adapt, modify, publish or distribute the Content created by you or stored in your user account for commercial, marketing or any similar purpose. But you grant us permission to access, copy, distribute, store, transmit, reformat, display and perform the Content of your user account solely as required for the purpose of providing the Services to you. Without limiting any of those representations or warranties, we have the right, though not the obligation, to, in our own sole discretion, refuse or remove any Content that, in our reasonable opinion, violates any of our policies or is in any way harmful or objectionable. By submitting content to the My CP & Me service you consent to having that content posted to our social media profiles. These profiles include: Facebook, Google+, Twitter, Instagram, Pinterest, and YouTube.

4. Backups

We perform regular backups of the Website and Content and will do our best to ensure completeness and accuracy of these backups. In the event of the hardware failure or data loss we will restore backups automatically to minimize the impact and downtime. Backups are preformed on a weekly basis.

5. Links to Other Websites

Although this Website may be linked to other websites, we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked website, unless specifically stated herein. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their websites. We do not assume any responsibility or liability for the actions, products, services and content of any other third parties. You should carefully review the legal statements and other conditions of use of any website which you access through a link from this Website. Your linking to any other off-site pages or other websites is at your own risk.

6. Prohibited Uses

In addition to other terms as set forth in the Agreement, you are prohibited from using the website or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability. Read more about what abuse is defined as in our Abuse Policy, submitting a false claim of abuse is prohibited and may result in the termination of the reporter’s account; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet or to upload content in any way deemed inappropriate by our Abuse Policy including (but not limited to): images or content (in any other form) of vulgarity, slander, profanity, racism, etc; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses. Violating any part of this agreements means you relinquish all rights to the account (and the content therein) to website operator. As such it is to the sole discretion of website operator to do whatever to the account in the event of violation as the account becomes sole property of website operator.

7. Intellectual Property Rights

This Agreement does not transfer from Website operator to you any Website operator or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with Website operator. All trademarks, service marks, graphics and logos used in connection with our Website or Services, are trademarks or registered trademarks of Website operator or Website operator licensors. Other trademarks, service marks, graphics and logos used in connection with our Website or Services may be the trademarks of other third parties. Your use of our Website and Services grants you no right or license to reproduce or otherwise use any Website operator or third-party trademarks.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Website operator, its affiliates, officers, directors, employees, agents, suppliers or licensors be liable to any person for (a): any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use or content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if Website operator has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of Website operator and its affiliates, officers, employees, agents, suppliers and licensors, relating to the services will be limited to an amount greater of one dollar or any amounts actually paid in cash by you to Website operator for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

9. Changes and Amendments

We reserve the right to modify this Agreement or its policies relating to the Website or Services at any time, effective upon posting of an updated version of this Agreement on the Website.
